Yes, it will only send last words, if last words has been set by the victim.

I'm pretty sure that foul language won't be held against us as final words. As long as it's not racial or truly fucked up, of course.

Same rules apply as the other areas of the game.

Wouldn't this be better if you set it when you get "You are dead xxxxx" page then your last words could be more relevent to your death.

I really like the last words thing.. But I also would rather see it on the "You are dead" screen so I'm able to respond according to the whisper.

It's all the same to me. "You stole my fort, you bastard. Me prepared to have your name follow me around on my profile picture for eternity."
